What Does a Personal Injury Lawyer Do?

A personal injury lawyer focuses on cases where people are injured and killed by accidents, carelessness, and other mistakes.  We represent everyday people going through some of the worst times in their lives, and we try to make things better by getting the people responsible for the accident to pay for their damages.

    We can help with

    • Slip and fall accidents
    • Car accidents
    • Pedestrian and bike accidents
    • Defective product injury cases
    • Construction accidents
    • And more.

Our goal as your personal injury lawyers is to get the insurance company to pay for your damages through a settlement and, if that is not possible, then our goal is to fight the case in court.

    All in all, we can…

    • Collect evidence to build your case
    • Prepare any court documents and filings
    • Review and research the law when it comes to unique or challenging legal matters
    • Apply our evidence and legal research to your case
    • Use our past experience with insurance companies to guide us in putting a value on your case, analyzing the chances of a fair settlement, and determining whether trial will be necessary
    • Generally representing and advising you on all matters connected to your case.

What Damages Can I Claim for My Injuries?

Most personal injury cases involve three main areas of “compensatory” damages:

    • Medical bills
    • Lost earnings
    • Pain and suffering.

Medical bills and lost earnings are examples of “economic damages” – the expenses and bills you face because of the accident.  While these are the two most common, you can also claim other incidental expenses, property damage costs, and other economic damages related to your accident.

“Pain and suffering” is essentially a synonym for “non-economic damages” – that is, damages to pay for the non-monetary harms.  This sees the defendant paying you money to make up for the pain, mental anguish, emotional distress, and other harms you faced.

In some cases, you can also get “punitive” or “exemplary” damages.  These do not pay you back for harm you suffered, but are extra damages the defendant has to pay you to punish them for wrongdoing.  These are not always available and usually require quite reckless actions from the defendant.

How Do I Start My Injury Case?

Most cases begin as insurance claims.  You do not have to file the claim on your own; our attorneys can help you do this.  We will send demand letters to the insurance company telling them exactly what damages you need paid, and we can negotiate back and forth with them.

Most early settlement offers are too low, and we cannot usually advise taking that offer.  Instead, we will push back, produce more evidence, and show them there is no point in fighting the case.  Then, if they still will not pay a fair value, we can file in court.

In a lawsuit, the case will eventually go before a judge and jury if it still does not settle.  But before that, there are motions, filings, and hearings we will take care of as your lawyer.  Then, if we need to, we will fight the case at trial.

What Evidence Do I Need to Collect?

We can help you collect most of the evidence in your case, especially when it comes to things you get after the day of the accident.  For example, we can depose witnesses and get their testimony, request your medical records, and demand that the defendants turn over any video or security footage they have.

However, on the day of the accident, there is a lot of important evidence you can collect, too.  If you can, try to write down or take note of…

    • Who was involved and their contact info
    • Any witnesses who saw the accident and their contact info
    • Whether any security cameras might have caught the accident
    • When and where it happened
    • What dangerous conditions might have contributed to the accident.

You should also call 911 if you need medical attention and go to the hospital for treatment, which will help you get better and produce medical records of the care you needed.  You should also call 911 and report the accident to the police if it involved cars, trucks, or other vehicles.

Our lawyers can advise you on any other evidence to collect.

How Do I Know if My Settlement is Enough?

You should never trust the insurance company to voluntarily offer you enough money for your case, and you should never accept damages without having our attorneys review the offer first.

You can generally assume that early offers will be far too low.  These might not even take your actual damages into account, and insurance companies might just be trying to settle quickly by throwing money at you with the hope that you will not question the amount.

A good settlement will account for all of the areas of damages you faced, including past and future lost wages and pain and suffering.  Many insurance companies will leave off pain and suffering and focus on medical bills, potentially leaving out important areas of damages.

If you accept a settlement, your case is over, so never jump the gun on accepting an offer until your lawyers have reviewed your case.
